AstroFrame Academy is a commercial brand operated by ERREVU' SRL.
By placing an order on this website, you agree to these Terms and Conditions of Sale. Please read them carefully before completing your purchase.
1. Definitions
For the purposes of these Terms:
“AstroFrame Academy”, “we”, “us” or “our” means ERREVU' SRL, operator of the AstroFrame Academy brand and website.
“Website” means astroframeacademy.com.
“Customer”, “you” or “your” means the person purchasing or using our digital products.
“Digital Products” means e-books, PDF guides, downloadable files, checklists, educational materials, digital resources and any other non-physical content sold through the Website.
“Order” means a purchase completed through the Website.
2. Scope of These Terms
These Terms apply to all purchases made through the Website.
The Website sells digital educational products related to astrophotography, night sky photography and beginner-oriented photography education.
No physical product is shipped unless expressly stated otherwise on the relevant product page.
These Terms should be read together with our Legal Notice, Privacy Policy, Cookie Policy, Refund Policy and any additional information provided on the relevant product page.

4. Product Information
Before placing an order, the Customer is invited to carefully review the product page, including the product description, format, language, technical requirements, content included, price and any specific conditions applicable to the product.
The Digital Products sold on the Website may include, depending on the offer:

5. Educational Purpose and No Guaranteed Results
The Digital Products provided by AstroFrame Academy are intended for educational and informational purposes only.
Astrophotography results depend on many factors, including but not limited to:

safety and accessibility of the chosen location.
We do not guarantee that you will achieve specific photographic results, specific image quality, specific technical outcomes, income, professional opportunities or any other specific result by purchasing or using our Digital Products.
6. Placing an Order
To purchase a Digital Product, the Customer must follow the checkout process available on the Website.
Before submitting the Order, the Customer has the opportunity to review the selected product, price, billing information, payment method and any other information requested during checkout.
The Customer is responsible for ensuring that all information provided during checkout is accurate, complete and up to date, including the email address used for delivery.
An Order is placed when the Customer completes the checkout process and confirms the purchase.
7. Order Acceptance and Contract Formation
After placing an Order, the Customer may receive an order confirmation email or other confirmation message generated by Shopify or by the systems used by the Website.
The purchase contract is considered concluded when the Order is accepted and payment is successfully processed.
We reserve the right to refuse, cancel or refund an Order where necessary, including in cases of suspected fraud, payment issues, technical errors, pricing errors, product unavailability, violation of these Terms or any other legitimate reason.
If an Order is cancelled after payment has been made, we will refund the amount paid using the same payment method used for the original transaction, unless otherwise agreed or required by applicable law.
8. Prices, Taxes and Currency
Product prices are displayed on the Website before checkout.
Prices may be displayed in the currency configured on the Website or selected during checkout.
Unless otherwise specified, prices may be shown inclusive or exclusive of applicable taxes depending on the Customer’s location, Shopify settings, tax configuration and applicable law.
Any applicable taxes, fees or charges will be displayed, where required, during the checkout process before the Customer completes the purchase.
The Customer is responsible for any taxes, duties, charges or fees that may apply in their country of residence or purchase, unless such amounts are collected directly at checkout.
9. Payment
Payments are processed through the payment methods made available on the Website, which may include credit cards, debit cards, PayPal, Shopify Payments or other third-party payment providers.
Payment information is processed by third-party payment providers. AstroFrame Academy does not store full payment card details on its own systems.
By submitting payment information, the Customer confirms that they are authorised to use the selected payment method and that the payment information provided is accurate.
If payment is declined, rejected, reversed or otherwise not completed, the Order may not be processed or access to the Digital Product may be suspended or cancelled.
10. Delivery of Digital Products
The Digital Products are delivered electronically.
After completing the purchase, the Customer receives access to the purchased Digital Product through the delivery method indicated during checkout, on the order confirmation page, by email or through another digital delivery system used by the Website.
Delivery may include, depending on the product and the system used:

a download link;
-
access to a PDF or digital file;
-
an email containing the purchased content or instructions;
-
access through a third-party digital delivery app integrated with Shopify.
No physical shipment is provided.
The Customer is responsible for checking their email inbox, spam folder, promotions folder or other filtered email sections if they do not receive the delivery email.

11. Technical Requirements
The Customer is responsible for ensuring that they have the necessary device, software, internet connection and technical ability to access and use the Digital Product.
Digital Products may require commonly available software, such as a PDF reader, web browser, email access or file extraction tools.
We are not responsible for the Customer’s inability to access a Digital Product due to incompatible devices, outdated software, lack of internet access, incorrect email address, local restrictions, third-party service issues or other circumstances outside our reasonable control.
However, if the Customer experiences a technical issue with the delivery or accessibility of the purchased file, they may contact us and we will make reasonable efforts to assist.
12. Immediate Access to Digital Content
The Digital Products sold on this Website are generally provided through immediate digital access or download after purchase.
By purchasing a Digital Product with immediate access or download, the Customer expressly requests and agrees that the performance of the contract begins before the end of any statutory withdrawal period that may apply.
Where required by applicable consumer protection law, the Customer may be asked to expressly acknowledge that, once access to or download of the Digital Product has started, they lose the right of withdrawal in relation to that Digital Product.
13. Right of Withdrawal for Digital Products
If the Customer is a consumer located in the European Union or in another jurisdiction providing a statutory right of withdrawal, they may have a right to withdraw from a distance contract within the applicable legal period, unless an exception applies.
For Digital Products supplied on a non-physical medium, the right of withdrawal may be lost once the performance has begun, provided that the Customer has given prior express consent to immediate performance, acknowledged that they lose the right of withdrawal as a result, and the required confirmation has been provided.
Accordingly, once the Digital Product has been delivered, accessed or downloaded following the Customer’s express consent, refunds are generally not available, unless required by applicable law or approved under our Refund Policy.
Nothing in these Terms limits any mandatory consumer rights that cannot be excluded under applicable law.
14. Refund Policy
Due to the nature of Digital Products, all sales are generally final once the Digital Product has been delivered, accessed or downloaded.
Refunds are generally not provided in the following cases:

the Customer changed their mind after purchase;

the Customer purchased the wrong product by mistake;

the Customer did not read the product description before purchase;

the Customer no longer wants or needs the product;

the Customer expected a different result from using the educational content;

the Customer lacks the necessary equipment, software, device or technical ability to use the product;

the Customer has already accessed or downloaded the Digital Product.
However, we may review refund requests in specific cases, including:

duplicate purchases made by mistake;

incorrect file delivery;

technical issues preventing access to the purchased file, where the issue cannot be resolved by customer support;

a corrupted or defective file that cannot be replaced;

other exceptional cases assessed at our discretion;

cases where a refund is required by applicable law.

15. Digital Product Licence
Purchasing a Digital Product does not transfer ownership of the intellectual property rights in that product.
Upon purchase, the Customer receives a personal, limited, non-exclusive, non-transferable and revocable licence to access and use the Digital Product for personal educational purposes only.
Unless expressly stated otherwise in writing, the Customer is not allowed to:

copy, reproduce or redistribute the Digital Product;

resell, sublicense, rent, lend, share or commercially exploit the files;

upload the Digital Product to websites, marketplaces, forums, cloud folders, social media groups, Telegram groups, Discord servers or file-sharing platforms;

give access to the Digital Product to third parties;

modify and resell the Digital Product as their own;
-
use the Digital Product to create a competing product;
-
remove copyright notices, brand references or ownership information;
-
use automated systems to extract, reproduce or distribute the content.
The Customer may apply the knowledge, techniques and educational information learned from the Digital Product in their own personal or professional photography practice, provided they do not copy, redistribute, resell or exploit the Digital Product itself.
16. Intellectual Property Rights
All content available on the Website and in the Digital Products, including but not limited to texts, e-books, guides, layouts, graphics, images, checklists, templates, educational materials, brand elements, downloadable files, names, logos and design elements, is protected by intellectual property laws, unless otherwise stated.
All rights not expressly granted to the Customer are reserved by ERREVU' SRL or the relevant rights holders.
Any unauthorised use of the Website content or Digital Products may result in suspension of access, refusal of future purchases and legal action where appropriate.
17. Prohibited Conduct
The Customer agrees not to use the Website or Digital Products for unlawful, fraudulent, abusive or unauthorised purposes.
The Customer must not:

interfere with the operation or security of the Website;

attempt to gain unauthorised access to systems, accounts or files;

use the Website for fraudulent purchases or payment disputes;

Unless expressly stated otherwise, the purchase of a Digital Product does not include personalised consulting, one-to-one coaching, technical setup support, equipment configuration, photo editing services or professional review of the Customer’s images.
19. Third-Party Platforms and Services
The Website may rely on third-party platforms and services, including Shopify, payment providers, digital delivery apps, email services, analytics tools, hosting providers and other technical tools.
We are not responsible for interruptions, errors, downtime, delays, payment failures, email delivery issues or other problems caused by third-party platforms or services outside our reasonable control.
The Customer may be subject to the terms and policies of third-party service providers when using certain features of the Website or completing payment.
20. Availability and Changes to Products
We may update, modify, replace, remove or discontinue any Digital Product at any time.
We may also correct errors, update content, improve files, change product descriptions or modify product availability.
If a Customer has already purchased a Digital Product, they will receive the version available at the time of purchase unless otherwise stated.
Future updates, revised editions, new versions or additional bonuses are not included unless expressly stated on the relevant product page or offer.
21. Promotional Offers and Discounts
From time to time, we may offer discounts, promotions, bundles or special offers.
Promotional offers are valid only under the conditions stated at the time of the offer and may be changed, suspended or withdrawn at any time.
Discount codes must be used before completing the purchase and cannot be applied retroactively unless we decide otherwise at our discretion.
Promotions have no cash value and may not be combined with other offers unless expressly stated.

23. Limitation of Liability
To the maximum extent permitted by applicable law, ERREVU' SRL, AstroFrame Academy and their representatives shall not be liable for indirect, incidental, consequential, special, punitive or economic losses arising from or related to the use of the Website or Digital Products.
This includes, without limitation, loss of profit, loss of revenue, loss of data, business interruption, equipment issues, travel costs, failed shoots, missed opportunities, personal dissatisfaction or inability to achieve specific results.
Our total liability for any claim related to a purchase shall not exceed the amount paid by the Customer for the specific Digital Product giving rise to the claim, except where such limitation is not permitted by applicable law.
Nothing in these Terms excludes or limits liability for fraud, intentional misconduct, gross negligence, death or personal injury where such exclusion is not permitted by law, or any mandatory consumer rights that cannot be excluded.
24. Safety and Outdoor Activity Disclaimer
Astrophotography and night photography may involve outdoor activity, night travel, remote locations, low visibility, weather exposure, uneven terrain and other risks.
The Customer is solely responsible for choosing safe locations, checking weather forecasts, respecting local laws, obtaining any required permissions, protecting their equipment, avoiding dangerous areas and taking appropriate safety precautions.
AstroFrame Academy and ERREVU' SRL are not responsible for accidents, injuries, property damage, equipment damage, fines, travel issues, unsafe conduct or other consequences resulting from the Customer’s use or application of the information provided in the Digital Products.
25. Privacy
The processing of personal data in connection with the Website, Orders, payments, email communications and customer support is described in our Privacy Policy.
By using the Website and placing an Order, the Customer acknowledges that personal data will be processed as described in the Privacy Policy.
26. Force Majeure
We shall not be responsible for delays or failures caused by events beyond our reasonable control, including but not limited to internet outages, platform downtime, cyberattacks, payment provider issues, hosting failures, technical disruptions, natural disasters, strikes, legal restrictions, acts of government or other force majeure events.
27. Governing Law
These Terms and any purchase made through the Website are governed by Italian law, unless mandatory consumer protection laws in the Customer’s country of residence provide otherwise.
For consumers, any mandatory rights granted under applicable consumer protection laws remain unaffected.
